Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Carfolio website, mobile application, and services (collectively, the "Service") provided by Jonathan Konyen eU ("Carfolio", "we", "us"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be of legal age or have authority to bind your organisation.

2. Description of service

Carfolio is a digital portfolio and management platform for private vehicle owners. Features include: vehicle registration and tracking, maintenance and cost logging, document storage and AI-powered categorisation, service recommendations, total cost of ownership (TCO) analysis, and ownership transfer tools. Features vary by subscription tier (Free, Driver, Pro).

3. Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated. Notify us immediately of any unauthorised use.

4. Acceptable use

You agree not to misuse the Service. Prohibited conduct includes: unlawful use; fraud or spam; intellectual property infringement; security interference (malware, probing, scraping); reverse engineering; circumventing technical limits; reselling or redistributing access; and uploading content you do not have rights to.

5. Intellectual property

Carfolio retains all ownership rights in the Service, its software, documentation, branding, and underlying technology. You retain ownership of your vehicle data and uploaded content. You grant us a limited, non-exclusive license to host, process, and display your content solely to provide the Service.

6. Subscriptions, payments and Paddle Merchant of Record

Paid subscriptions (Driver, Pro) are billed through our Merchant of Record, Paddle.com. Paddle handles all payment processing, billing, tax collection, and invoicing on our behalf.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms. Subscriptions renew automatically unless cancelled. You may cancel at any time in your Account Settings.

7. Service level

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service is provided "as is". We disclaim all implied warranties (merchantability, fitness for purpose) to the fullest extent permitted by law.

8. AI-generated content

Carfolio uses AI to analyse documents, categorise receipts, and generate service recommendations. AI outputs may be inaccurate and are for informational purposes only. You are responsible for verifying AI-generated data before acting on it. Carfolio is not liable for decisions made based on AI recommendations. AI outputs are not a substitute for professional mechanical or legal advice.

9. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the total fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages (loss of profits, data, goodwill), except where prohibited by law (fraud, death, or personal injury).

10. Indemnity

You agree to indemnify and hold harmless Jonathan Konyen eU and its representatives from any claims arising out of your content, unlawful use of the Service, or violation of these Terms.

11. Suspension and termination

We may suspend or terminate your access for: material breach of these Terms; non-payment; security or fraud risk; or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately. You may export your data before deletion. We reserve the right to delete your data 30 days after account termination.

12. Governing law and disputes

These Terms are governed by the laws of Austria, excluding its conflict-of-law provisions. Disputes shall be resolved in the courts of Vienna, Austria. We prefer amicable resolution and encourage you to contact us before initiating legal proceedings.

13. Changes to terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice. Continued use of the Service after changes constitutes acceptance.
